(herein referred to as ‘Blue Ocean’, ‘we’, ‘our’ or ‘us’)
BOOKING TERMS AND CONDITIONS
In the event that you are booking an activity on behalf of a group, ”you” and “your” shall be deemed to include each member of that group. Furthermore, you as the individual booking the activity agree to ensure that each member of the group has read and agrees to comply with these terms and conditions.
A completed booking form or full payment must be received prior to you attending your chosen activity.
Covid update!– As of November 2020 any new bookings effected by the governments ever changing policies and lockdowns etc. will be exempt from our standard Terms & Conditions and will be entilted to a change of date or refund as reassurance for our customers.
Cancellations by us
Every attempt will be made to ensure that activities run as scheduled. However, we reserve the right to cancel activities at any time without notice due to unsuitable conditions, forecasts, prevailing weather conditions, or due to any other factors beyond our control or if we feel that there are unmanageable risks.
In the event that we have to cancel an activity due to adverse weather conditions or any other factors beyond our control you will be provided with the opportunity to book a suitable alternative activity (if available) or book another date, we do not provide refunds in these circumstances.
Cancellation by You
We recognise that occasionally you may wish to change your mind. If you wish to cancel your activity booking we operate the following cancellation policy:
1 -Deposits are non refundable.
2 If we receive your cancellation 14 days or less before your activity start date, we will not issue you with a refund on the balance payment.
If weather conditions on arrival mean we have to change, shorten or alter the activity in anyway this will be fully explained beforehand by your Instructor and you will be given the opportunity to continue or book another date. If you decide to continue you will not be entitled any refunds, partial refunds or rebook another date thereafter.
All persons under the age of 18 years (‘Under 18’s’) will require a completed Medical Consent Form and Safety and Risk Declaration signed by an appropriate parent or legal
guardian before being allowed to participate in any activity. The requisite consent form is available from us and a duly completed and signed consent form must be returned prior to participation.
Data Protection / Privacy
The information you have supplied will be treated in accordance with the provisions of the Data Protection Act 1998.
During activities we often take photographs which will be uploaded online and in submitting your booking you are indicating your consent, unless you indicate otherwise.
Adherence to Rules
You must not do anything (or omit to do anything) which may cause damage or loss to our property or facilities, to other participants or cause nuisance, annoyance, disturbance, inconvenience or injury to any other persons.
Any persons who are thought to be under the influence of drink / and or drugs (at the sole discretion of Blue Ocean staff) will not be permitted to partake in any activities. No refund will be given.
This agreement is governed and construed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
